Job description

Duties THIS IS A T5 EXCEPTED SERVICE PERMANENT POSITION The primary purpose of the ATTORNEY-ADVISER (GENERAL), GS-0905-13, is to serve as the full-time professional legal adviser and support to the Adjutant General, the Commander of federally recognized Army and Air National Guards, and state/territory unique public defense or safety structures or wing commander. In this primary purpose, this position also serves as the full-time professional legal advisor and support to the Intergrated Primary Prevention Workforce (IPPW), and subordinate commanders to support the state prevention efforts relating to primary prevention of upstream harmful behaviors including sexual assault, sexual harassment, and domestic abuse. Serves as the state/territory National Guard litigation point of contact. Represents the state/territory National Guard in all legal matters in state/territory of original or appellate jurisdictions, to include matters pertaining to harmful behaviors, sexual crimes, sexual harassment, and domestic violence/abuse. Conducts investigations of fact and legal sufficiency; advising on administrative remedies; develops the trial strategy, content and means of presentation, and trial delivery; makes motions; and conducts post-trial duties. Prepares litigation reports, briefs, pleadings, and other papers associated with litigation involving the state/territory National Guard interests. Advises on discovery obligations for senior leaders and members of the state/territory National Guard. Serves as an attorney/adviser providing acquisition and fiscal legal advice to the state/territory's assigned United States Property & Fiscal Officer, particularly in the area of emerging requirements in victim support and legal resourcing (the Chief of the National Guard Bureau's agent in the state/territory) and active-duty military advisers. Advises Army National Guard (ARNG) and Air National Guard (ANG) contracting officers, reviews contracts, procurement actions and real property matters involving Federal and state/territory funds (some involving substantial amounts of money) for legal sufficiency, appropriate titling and claim initiation or resolution actions. Responsible for advising on any fiscal contracts that address DoD policy and programs aimed at integration and implementation of the prevention of sexual harassment, sexual assault, victims' right, workplace violence, domestic violence, family abuse, and suicide. Provides or participates in various training activities, prepares reports, and provides counsel on complex ethics issues and policies; and ensures Federal and state/territory annual administrative reporting requirements are met. Reviews sensitive financial disclosure statements for General Officers and other key personnel. Reviews Claim Investigating Officer reports, adjudication recommendations, regardless of filing location, and approves forwarding of actions to the appropriate claim's office. Reviews for legal sufficiency and approves or dispatches recommended action to approving authorities a variety of documents or investigative determinations such as freedom of information requests, financial liability investigations, line of duty determinations, and similar administrative proceedings. Provides oversight and guidance to the state/territory Judge Advocate's Legal Office, Legal Assistance and Preventative Law Programs, and supervises assigned full-time attorney and support staff. Coordinates the provision of legal services throughout the state and oversees the assignments of attorney and paralegal personnel within the subordinate units in both the Army and Air National Guard to accomplish all legal support requirements. The position resides within the infrastructure and support functions of the state National Guard; the incumbent is not subject to mobilization, nor is the work described part of the military mission; and the incumbent does not perform a key advisory or essential administrative role that is inherently military. In addition, the position must meet one of the following: It does not have a comparable military function; the position is required in full-time (civilian) role when the organization, or similar military position, is mobilized to perform continuing post-mobilization functions; or the position requires a skill or competency that necessitates technical expertise or professional qualifications that cannot be readily found in the military structure of the state military force. May make additional selections within 90 days of eligible(s) issuance. Must maintain proper security clearance. Must either be currently in good standing (certified) with a State Bar or able to obtain certification. Must be a graduate of an ABA-accredited law school. Security Clearance: at a minimum a National Agency Check is required prior to position assignment. Qualifications ATTORNEY-ADVISER (GENERAL), GS-0905-13: Must have at least one year of specialized experience, equivalent to at least the GS-12 level, or equivalent pay band in other pay systems in the Federal government. This experience may also have been obtained in the private sector, but must demonstrate that it is comparable to the GS grade indicated. Specialized experience may have been demonstrated by performing duties such as: Experience acting as a legal adviser and attorney for the state/territory National Guard, responsible for the formulation of state/territory legal policy and its execution legal representation; legal initiatives; interpretation and litigation of U.S. and state/territory(s) constitutional, civil, criminal, labor law; international law and treaty agreements; and a full spectrum of expert legal advice; Experience advising and providing legal sufficiency reviews of Adjutant General and other senior leaders messages of sexual assault and sexual harassment prevention methods in formal and informal settings , and the review of any implementation of DoD policy or guidance related to competencies leaders must have related to overseeing prevention; Responsible for legal counsel to the Adjutant General and Commanders on any public or private sector collaborations to develop definitions for essential primary prevention competencies for leaders and performs legal review of any associated policy and guidance for evaluation guidance as to prevention; Experience serving as legal counsel to Adjutant General and Commanders on legislation, regulation, or guidance as to creating protective environments and promoting healthy social norms specific to military communities, which can include advising on any collaborations with local, state, and federal partners such as county health departments, State health departments, schools, the CDC, Department of Education, other government agencies, academia, and/or other industry that can ensure that the military can evaluate and assess the impact of their community-level prevention strategies both in the short and long-term .
